What came to my mind was EVE online. It's a pretty hardcore game all in all, but well balanced enough so that you still be a total carebear, not to say there won't still be risks. In EVE the safe zones are monitored by police-esque NPC's that kill players shortly after they commit a crime. However in HC, this wouldn't work, the crime would have to be detected, the admins would have to intervene, it'd be unavoidable yadda yadda.
However, the idea that selected players; upon evidence that they have comitted a crime, could be blacklisted as outlaws, is very interesting. If marked as an outlaw, the player to kill that outlaw, or have them surrender to them via a /code type message would be rewarded. While the outlaw has to serve a sentence in prison?
In essence, outlaws have their respawn zone changed to that of a the prison cell in a regioned area, only set free when they have served their sentence ( Petty theft - 10 mins, Mass murder - 2 hours, whatever).
Haha, while typing I also imagined a jailbreak type scenario where the prisoners are set free by their friends. Or paying their bail coin to get them out straight away.
